After a long and drawn-out legal battle, Joseph Abboud has won the right to use his name commercially on a restricted basis. A federal judge in Manhattan ruled that Abboud cannot use his name as a trademark, service mark, trade name or brand name or on his line of menswear called Jaz. However, he can use it in ads if it is employed descriptively, in the context of a complete sentence or descriptive phrase, and is no larger than the surrounding words.
